The following terms and conditions apply to users, viewers and anyone who visits this site. You must be of legal drinking age in your country or residence to use this site; if you are not, do not use this site.

The promoter of the Tusker Cider Badge Challenge is Kenya Breweries Limited (KBL) whose registered office is located in Ruaraka, Nairobi, Kenya.

By participating in this challenge, you agree to the terms and conditions stipulated below.

1. The challenge will run from Monday 11th December, 2017 to Friday 29th December, 2017.

2. Eligibility

The challenge is open to residents of Kenya aged 18 years and over at the date of entry, except employees of EABL, KBL, UDV, EAML, Zilojo Limited, IMG Events & PR, BBDO East Africa, EXP Momentum Kenya, Posterscope East Africa and any other supplier or third party directly involved with the administration and execution of this challenge as well as their immediate family members. KBL shall have the sole and absolute discretion to exclude any person from participating in the challenge without any obligation to furnish any notice and/or reason.

3. How to Participate

The rules of the challenge and how to enter are as follows:

a. Comment on our Facebook social media posts related to the Tusker Badge Challenge, giving the information required in each post.

b. Each participant is only allowed ONE comment. Any additional comments will be disregarded.  

c. By participating in this challenge, each participant confirms that the comments provided:

  • will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything that is unlawful, libelous, racially disparaging, defamatory, obscene, offensive, or imply association with violent, aggressive, dangerous or anti-social behaviour;
  • will not disrespect cultural differences/sensitivities;
  • will not feature children or persons under the age of 18 years;
  • will not feature animals in the content;
  • will not create the impression that alcohol consumption contributes towards or is a pre­ requisite for social, business, academic, sporting or sexual success;
  • will not show or encourage consumption of alcohol while driving motor vehicles of any kind including but not limited to cars, motorbikes, speedboats, jet skis, or aircraft

d. Our social media team will assess the comments and select 12 winners with the most compelling and interesting stories. The judges' decision on the winners will be final and cannot be contested.

 e. Every Monday, winners from the previous week will be announced. The full list of winners will be announced on Friday 5th January, 2018.

4. Prizes

a). There will be food vouchers, movie tickets and shopping vouchers.

b). The winner win be announced on our social media platforms and can only win once.

c). The prize is not transferrable and may not be deferred, changed or exchanged for any other item.

d). KBL gives no warranties about the prizes and the participants agree to accept the prizes on an "as is" basis. Subject to applicable law, the participants agree  that they shall not hold  KBL liable for any damage that anyone may suffer as a result of the prize(s) or this challenge including consequential and economic loss.

e). KBL reserves the right to select any number of reserve winner(s) in the event that any winner is subsequently disqualified for any reason whatsoever.

f). KBL reserves the right to vary, amend or substitute the prizes offered as part of this challenge at any time, for any reason and without liability to any person.

g). KBL reserves the right to claim the full cost of the prize from any winner in the event that it is determined by KBL that the winner has breached one of the terms stated herein.

h). To the extent that any taxes, duties, levies or other charges may be levied on a prize by any competent government or regulatory body, the winner(s) will be liable therefore and KBL will not increase the value of the prize to compensate for such charges.

5. Use of Personal Data

a). By participating in the challenge, all winners of the prizes agree that their full names, photos, video footage and other details will be made public in such media as KBL may choose.

b). All  materials including publicity materials will remain the sole property of KBL.

c). Use of the materials stated above shall be at KBL's discretion and KBL shall be entitled to disclose any of the participants' details for administering the challenge, marketing and research related activities, fraud prevention and such other purposes as may be provided in the terms and conditions herein and the law.

6. Disqualification and Termination

a) This challenge is offered at the sole discretion of KBL and KBL reserves the right to terminate or temporarily suspend this challenge in the event of technical or other difficulties that might compromise its integrity. In the event of a dispute, the decision of the challenge judges is final and binding and no correspondence will be entered into.

b) KBL shall have the right at any time to amend, vary and supplement the terms and conditions of this challenge and is entitled to suspend or withdraw this challenge at any time at its discretion, without prior notice or reason and liability to any person. For the avoidance of doubt, participants shall not be entitled to any damages or compensation whatsoever or howsoever arising as a result of such amendment, suspension or cancellation.

c) KBL has the right to reject, disregard or disqualify any entry, participant or winner, on any basis including but not limited to incomplete entry, fraud and/or failure to comply with the terms and conditions stated herein and in a manner as KBL deems fit. No objection in this regard shall be entertained. In particular, no participant shall procure another person to tamper with any process or operation of the challenge on the website, manipulate the outcome of the challenge and/or breach these terms and conditions or any other applicable legislation or regulation.

7. Other Terms and Conditions

a) There is no entry fee and no purchase necessary to enter this challenge. Participants will not be required to send money, airtime, mobile money funds or any other consideration in order to participate or claim any prize in this challenge. KBL will not be liable for any losses or other damage incurred by any person who does not heed this caution.

b) KBL is the owner or licensee of all intellectual property rights on the site and any material published on it. Material from this site may not be modified, copied, reproduced, distributed, republished, uploaded, posted, or transmitted in any way. Neither title nor intellectual property rights are transferred to you by use of or access to this site; rather, all rights, title and interest in and to all aspects of the site remain the property of KBL. Nothing contained in these terms and conditions shall be construed as conferring any license or right to use any trademark, design or copyright of KBL or any other third party.

c) By submitting any content, in form of written, photographic or graphics, you agree to grant KBL license to use that submission. KBL will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your submission.

d) Neither KBL and its affiliates nor its respective advertising, media and PR agencies or their trading partners shall be liable in any way whatsoever for any loss, damage or costs howsoever arising, suffered by a participant in this challenge and/or winner in the prize offered.

e) To the extent relevant, this challenge shall comply with the Laws of Kenya, the Diageo Code of Business Conduct and the Diageo Marketing Code.
